CA Methods of Service
California allows for many different methods of service. Which one is best for you will depend on the defendant, specifically whether they’re an individual, business, or organization. That said, here’s a rundown of the most common methods available:
Personal service: When someone who is not a party to the case hand-delivers documents to the other side
Service by mail: When someone who is not a party to the case mails documents to the other side
Substituted service: After 3 or more failed attempts to serve the papers, the process server can then leave the papers with someone else at the party’s residence
Service by notice and acknowledgment of receipt: When the other side agrees to be served by mail and will sign an acknowledgment of receipt for the court
Service by posting on the premises and mailing (for eviction cases only): Sometimes called “nail and mail,” this is when you post a notice on the premises
Service by publication: When you publish the summons and complaint in a newspaper (this is usually for when you do not know where the other party lives or works)
Service by posting (at the courthouse): When the summons and complaint are posted in a designated place at the courthouse itself
Process Server Rules in California
There are many rules on how to be a server in California, so we make sure our process servers are specially trained. Servers can be anyone over 18 who is not part of the case and will serve the paperwork in the time required so you can rest assured your documents are getting where they need to go.
Who to Serve and Where
Figuring out the details of who and where will depend a lot on your specific case. Sometimes it will be obvious, like when you’re suing a specific individual, then that’s who you’ll serve. Other times, like if you are suing a business, corporation, state, or landlord, then our process servers in California will be sure to take into account the specifics.
How It Works
Step 1
Upload documents
In a big state like California, making things as seamless as possible with Proof is our goal. It only takes a few minutes to create your job and upload all your necessary documents at once. Once that’s done, we’ll find a process server in the state for you.
Step 2
Track Progress of Service
Make sure you’re informed of everything from how many attempts to reach the other party have been made to the exact GPS coordinates of the hand-off. Plus, with our 2-way chat, you’ll always be connected to your process server for any questions you have.
Step 3
Receive the Proof You Need
We couldn’t call ourselves Proof if we didn’t ensure you’d get the proof you (and courts) need. That’s why we offer geo-tagged photos and affidavits so you know exactly when and where the other party received their docs.
