As is the case in most states, the most common method is personal service, where the process server hands papers directly to the recipient. This is normally completed in Florida by the county sheriff’s office, but it may be completed by a professional process server. Papers are typically delivered to the home or place of business.
In the case where a server is unable to serve papers personally in the state, there are a few other options. One is to leave with another individual at the known address, who must be at least 15 years of age. Another is to leave with an individual at the place of business, and you must notify the business beforehand. In Florida, if an employer refuses to let the agent serve legal papers at the business, they could be fined up to $1,000.
Who to Serve and Where
Ideally, a process server will serve the recipient of the papers directly, typically a defendant. However, as said above, another individual at the address may be served if the recipient cannot be served directly, and the employer at their place of business may also be served the papers in this event.
Papers must be delivered at the recipient’s home address or, if necessary, place of business. Proof requires the process server to take a geo-tagged image to provide the exact location of their successful service.
Process Server Rules in Florida
While most states allow anyone at least 18 years of age and unrelated to the case to serve the papers, Florida requires the process server to be a law enforcement officer, typically a sheriff’s deputy. Some county sheriffs have a list of their own professional process servers who are authorized to serve papers on their behalf. At times, the court may appoint a third-party to serve papers.
