Method of Service
The plaintiff filing the lawsuit is responsible for serving the summons and complaint to the named defendant(s), and New York provides many methods of service to choose between. However, the appropriate method depends on the status of the defendant, such as if they are an individual or an organization of some kind.
Nail and Mail
If other options cannot be completed, a rare method can be done where the papers are affixed to the door of the defendant’s residence and also mailed via first class mail. The mailing must take place within 20 days of when the method was used.
Proof of Service
There must be some form of proof that the service of process was completed. This is typically done through a signed affidavit by the one who completed the service, detailing the paper served, the person who was served (including date, time, and address), and evidence that service was conducted in an authorized manner. This is why it’s important to use a professional service like Proof to ensure the service of process is done correctly.
Personal Service
Personal service is the most common method of service, in which the summons is delivered within the state by hand to the person being served. New York law states that the one serving papers can be anyone 18 years or older, but it’s better to rely on a professional who understands the nuances of New York service of process. Proof only works with process servers with at least 2 years of experience working in the state.
Substituted Service
In the instances where papers cannot be served personally within state boundaries, there are other options of service. The summons can be delivered to another adult at their residence or place of business, but it must also be mailed via first-class mail to the home or business. If it’s delivered to a business, the envelope must be marked “personal and confidential” and have no indication that the mailing is from an attorney or a law office. Another option is delivering to a designated agent that the defendant has agreed upon, but this is not possible for divorce proceedings.
