NC Methods of Service
North Carolina allows for the following methods of service:
Personal service: The most preferred method of service, where someone not party to the case delivers the summons or other document physically to the recipient. In North Carolina, this can be done by the local sheriff for a fee of $30 or, if they’re not available, a professional process server.
Certified mail: If personal service isn’t possible, you can deliver your documents through registered or certified mail (you may also use a delivery service such as FedEx or UPS). For this to be legitimate, it must be delivered to their home and you must obtain a receipt of delivery.
Service by publication: As a last resort, if no other options are available, you may post your summons to the county newspaper of the recipient. To do so, you must receive permission from the court and prove you tried all other avenues. This must be done once a week for three consecutive weeks.
Who to Serve and Where
Depending on your case — namely whether you’re suing an individual or a company, government, or other entity — that will determine how to serve the papers. Serving an individual is straightforward, but for other kinds of services, your Proof process server will have to take other variables into account.
Process Server Rules in North Carolina
The simplest avenue for finding a process server is going to the local sheriff, who can deliver your documents for you for $30. If you go to a process server instead, they must be someone 21 years of age or older who is not a party of the case and is not related by blood or marriage to either party.
