PA Methods of Service
Pennsylvania offers many different types of service, but the best one for you will depend heavily on the nature of your individual needs and the details of your case. Here’s a quick rundown of the main methods:
Personal service: When someone who is not a party to the case hand-delivers documents to the other side
Service by mail: When someone who is not a party to the case mails documents to the other side
Substituted service: After 3 or more failed attempts to serve the papers, the process server can then leave the papers with someone else at the party’s residence
Service by notice and acknowledgment of receipt: When the other side agrees to be served by mail and will sign an acknowledgment of receipt for the court
Service by posting on the premises and mailing (for eviction cases only): Sometimes called “nail and mail,” this is when you post a notice on the premises
Service by publication: When you publish the summons and complaint in a newspaper (this is usually for when you do not know where the other party lives or works)
Service by posting (at the courthouse): When the summons and complaint are posted in a designated place at the courthouse itself
Who to Serve and Where
To answer this question, you’ll first need to look at the details of your specific case. If you’re suing another individual things are pretty straight-forward: they’re the person you’ll be serving, most likely at their residence or place of business. But if you’re suing a business, landlord, or other entity, then the correct person and place to serve your documents may vary.
Process Server Rules in Pennsylvania
Pennsylvania allows sheriffs to serve papers in their respective districts, and aside from that a competent adult can serve in a civil action, partition, declaratory judgment, or civil action, but look to the state code for more information.
